Our partner Mariana Lombardi contributed in an article for the legal news outlet JOTA on the decision of Judge Carlos Muta, of the Federal Court of Appeals for the Third Circuit (TRF3), ordering Albert Einstein Hospital to deliver 20 new pulmonary ventilators to the Federal Government, acquired from the company Magnamed.

The decision was issued last Wednesday (5/6), but Einstein claims that it cannot comply with it as the devices are already being used by Covid-19 patients in the Intensive Care Unit (ICU) of Municipal Hospital M’Boi Mirim, administered jointly with the City of São Paulo.

“The Federal Union may claim it suffered damages, but it is difficult to prove that damage, especially as Einstein is already using ventilators and it is not possible to compare lives, no life is more important than the other,” concludes Mariana.
